Terms of Service

1. Acceptance of Terms
By accessing or using PreBrief ("the Service"), operated by Aerial Sensing AI ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
PreBrief is a preflight risk assessment and compliance documentation tool designed for FAA Part 107 UAS (Unmanned Aircraft Systems) operators. The Service provides:
- Automated preflight risk briefs based on user-provided mission parameters
- Airspace classification and advisory layer information
- Weather data aggregation from third-party sources
- NOTAM and TFR visibility (when available)
- Compliance evaluation against 14 CFR Part 107 regulations
- PDF Evidence Pack generation for record-keeping
3. Decision-Support Limitation
PreBrief is a decision-support tool only. It does not provide legal advice, does not issue airspace authorizations, and does not render a legally binding determination of whether a flight is permissible. The Remote Pilot in Command (RPIC) retains full responsibility for all go/no-go decisions and regulatory compliance.
The Service is not a substitute for the RPIC's duty to perform preflight familiarization per 14 CFR § 107.49. All findings, advisories, and required-action items are informational. The RPIC must independently verify all information with official sources (FAA, NOAA, USS providers) before each flight.
4. Not a LAANC or Airspace Authorization Provider
PreBrief does not file, submit, or grant airspace authorizations of any kind. The Service may provide outbound links to FAA-approved UAS Service Suppliers (USS) for the purpose of obtaining LAANC authorization. Any authorization must be obtained independently through the appropriate FAA-approved channels.
5. Data Accuracy and Timeliness
The Service relies on third-party data sources including, but not limited to, NOAA weather observations, FAA airspace data, FAA NOTAMs, and FAA TFRs. While we make reasonable efforts to present current and accurate data:
- Data may be delayed, incomplete, or temporarily unavailable due to upstream service issues
- Airspace boundaries, UASFM grid ceilings, and regulatory data are refreshed periodically and may not reflect real-time changes
- Weather observations are point-in-time snapshots and conditions may change rapidly
- NOTAMs and TFRs can be issued with minimal notice and may not be reflected immediately
Each brief includes data-source timestamps and version stamps. Users must verify the currency of all data before flight, particularly on the day of operations.
6. User Accounts
Certain features (saved site profiles, mission history, PDF downloads) require account creation. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to update it as necessary.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive use of the Service.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Use automated tools to scrape, mine, or collect data from the Service
- Impersonate another person or provide false information
- Interfere with or disrupt the Service or its infrastructure
- Use the Service to generate fraudulent compliance documentation
8. Intellectual Property
All content, features, and functionality of the Service — including OPA/Rego policy logic, PDF templates, UI design, and documentation — are owned by Aerial Sensing AI and are protected by copyright, trademark, and other intellectual property laws.
Evidence Pack PDFs generated through the Service may be shared with clients, insurers, and regulatory bodies for their intended purpose (preflight documentation). This does not constitute a transfer of intellectual property rights in the Service itself.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AERIAL SENSING AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Without limiting the foregoing, we are not liable for any decisions made or actions taken based on information provided by the Service, including but not limited to decisions to fly or not to fly, route planning, or equipment selection.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any data provided will be accurate, complete, or current.
11. Indemnification
You agree to indemnify and hold harmless Aerial Sensing AI, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email. Continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Virginia.
